These terms are the agreement between Qwallet and the business using it. By creating an account you accept them. If you are accepting on behalf of a company, you confirm you are authorised to do so.

1. Who these terms are for

These terms govern your use of Qwallet — our website, the merchant dashboard, and the loyalty cards issued through it.

They are between Qwallet and you, the business. They are not the terms between you and your own customers. If you want cardholders to agree to something when they sign up for your card, publish your own terms and set them on the card's signup form — the dashboard has a field for exactly that.

2. Your account

  • Give accurate details when you sign up, and keep them current.
  • Keep your password to yourself. Anything done through your account is treated as done by you.
  • You are responsible for the staff accounts you create and for what those staff do — including scanning cards, adding stamps and redeeming rewards.
  • Tell us straight away if you think someone has got into your account.

3. Plans, limits and payment

Qwallet is sold as a subscription. Each plan sets how many card designs, locations, staff accounts and customers you may have; the current plans and prices are on our pricing page. Prices are in Qatari Riyals.

  • Subscriptions are billed in advance through Lemon Squeezy, our payment provider. Their terms apply to the checkout itself.
  • A plan renews for a further period unless you cancel before the current one ends.
  • Cancelling stops the next renewal. We do not refund the remainder of a period already paid for, unless the law requires it or we have failed to provide the service.
  • If you reach a plan's limits, we may ask you to upgrade before you can add more.
  • If a payment fails and stays unpaid, we may suspend the account. Section 12 explains what that means for cards already issued.

We may change our prices. Where a change affects a plan you are already on, we will give you notice before it applies to your next renewal.

4. The free plan

The free plan exists so you can try the service. It carries tighter limits, is provided as is, and we may change or withdraw it on notice.

5. Your customers' data is your responsibility

You decide what to ask your customers for and what to do with their answers. In data protection terms you are the controller of that data, and we process it for you on your instructions.

  • Make sure you have a lawful basis for collecting and using your customers' details, and tell them what you will do with them.
  • If you want cardholders to accept terms or a privacy notice when they join, publish it and set it on your signup form.
  • Send only the push notifications your cardholders would reasonably expect from you. Do not use them to market unrelated goods, and do not send them to people who have asked you to stop.
  • Honour the rewards you advertise on your cards. What a card promises is your promise, not ours.
  • If a customer asks you to correct or delete their data, act on it. We will help you do so on request.

If a claim is brought against us because of how you handled your customers' data or the rewards you offered, you will cover our reasonable costs in dealing with it.

6. Acceptable use

Do not use Qwallet to:

  • Break the law, or run a programme that would be illegal where it operates.
  • Impersonate another business, or use a brand, logo or trade mark you have no right to use.
  • Put anything offensive, deceptive or infringing on a card.
  • Send unsolicited marketing, or scrape, overload, probe or reverse-engineer the service.
  • Resell Qwallet as your own product without a written agreement with us.

7. Apple Wallet and Google Wallet

Cards are delivered into Apple Wallet and Google Wallet. Those are Apple's and Google's platforms, not ours.

They set their own rules for what a pass may contain and how it may be used, and they can change those rules — or their availability — without consulting us. We will do what we reasonably can to keep cards working, but we cannot promise that a platform will keep behaving as it does today, and we are not responsible for an outage on their side.

8. Content and intellectual property

Qwallet — the platform, the software behind it and our brand — stays ours.

Your logos, artwork and card content stay yours. By uploading them you give us permission to use them for the purpose you uploaded them for: generating and displaying your cards, including passing them to Apple and Google so the card renders on a phone. You confirm you have the right to use what you upload.

We may mention that a business uses Qwallet, and show its card design, as an example of our work. Tell us if you would rather we did not, and we will not.

9. Availability and support

We work to keep Qwallet running, but we do not guarantee uninterrupted service. We may take it down for maintenance, and will try to do that at quiet times.

10. No warranty

Beyond what this agreement says and what the law requires, Qwallet is provided as is. We do not promise that it will suit a particular purpose of yours, or that using it will produce any particular result for your business.

11. Limits on liability

Neither of us is liable to the other for indirect or consequential loss, or for lost profits, lost revenue, lost goodwill or lost data.

Our total liability to you for any claim arising out of this agreement is limited to the amount you paid us in the twelve months before the claim arose.

Nothing here limits liability that cannot lawfully be limited — including for fraud, or for death or personal injury caused by negligence.

12. Suspension and ending the agreement

You may close your account at any time, from the dashboard or by writing to us.

We may suspend or close an account that breaks these terms, that has an unpaid balance, or that puts the service or other users at risk. Where the situation allows it, we will warn you first and give you a chance to put it right.

When an account ends, the cards it issued stop being updated. A card already in a customer's wallet does not disappear, but it freezes at its last state, and no further stamps, points or rewards can be added. Tell your cardholders before you close an account, so nobody is left holding a card that has quietly stopped working.

You may ask us for an export of your data before an account closes. Afterwards we delete it as described in our Privacy Policy.

13. Changes to these terms

We may update these terms. The date at the top of the page shows when they last changed, and we will email account holders about any change that materially affects them. Continuing to use Qwallet after a change means you accept it.

14. Governing law

These terms are governed by the laws of the State of Qatar, and the courts of Qatar have jurisdiction over any dispute arising from them.
